Key Points:

  • Bail Granted: After hearing arguments on September 5, the court reserved its judgment.
  • Conditions of Bail: Kejriwal will be released from jail after 152 days. Both judges agreed to grant bail on a personal bond of Rs 10 lakh each.
  • Unanimous Decision: Both judges on the bench delivered a unanimous verdict.
  • 80 Days in CBI Custody: Kejriwal had been in CBI custody for 80 days.
  • Earlier Bail in ED Case: Kejriwal had already been granted interim bail by the Supreme Court in the ED money laundering case.

Kejriwal Challenges High Court Order:

Kejriwal had challenged the Delhi High Court’s order in the Supreme Court. The High Court had dismissed his plea challenging the CBI arrest and asked him to approach a lower court for bail. Kejriwal challenged both orders in the Supreme Court. He argued that the CBI arrest was illegal and sought his release and bail.

Senior Advocate Abhishek Manu Singhvi Raises Serious Questions:

Senior advocate Abhishek Manu Singhvi, appearing for Kejriwal, questioned the arrest and argued that it was illegal to arrest without serving a notice under Section 41A of the CrPC. Singhvi also stated that the Supreme Court has held in several of its judgments that bail is a rule and jail is an exception. Since Kejriwal holds a constitutional position, there is no possibility of him fleeing if granted bail.
