Punjab to Establish Special Fraud Detection Unit for Robust GST Enforcement: Harpal Cheema

In a significant move to strengthen tax enforcement, Punjab’s Finance, Planning, Excise, and Taxation Minister Advocate Harpal Singh Cheema announced the establishment of a state-level Special Fraud Detection Unit (SFDU), headquartered in Patiala. The dedicated unit aims to bring uniformity and streamline investigations into complex cases of Goods and Services Tax (GST) violations.

Key Objectives of the SFDU

Finance Minister Cheema stated that the SFDU will be tasked with detecting and investigating large-scale GST frauds, with a specific focus on curbing circular trading operations, exposing benami transactions, and eliminating bogus invoicing. The unit will be empowered to take stringent enforcement actions, including canceling suspicious GST Identification Numbers (GSTINs), preventing wrongful Input Tax Credit (ITC) claims, and recommending prosecution of offenders to ensure legal accountability.

Technology-Driven Approach

The SFDU will harness advanced technologies such as Artificial Intelligence (AI), data analytics, and centralized backend operations to enhance its investigative capabilities. The unit will conduct comprehensive data mining and pattern recognition across the state to identify anomalies in tax returns, transaction networks, and goods movement. Cheema emphasized that the SFDU will use data-driven red flags to target only suspicious or fraudulent taxpayers, ensuring honest taxpayers are spared unnecessary scrutiny. This strategic approach aims to balance effective enforcement with taxpayer convenience, fostering a more efficient and taxpayer-friendly administration.

Composition of the SFDU

Finance Minister Cheema detailed that the SFDU will comprise a multi-disciplinary team, including experienced tax officers, skilled IT professionals, a chartered accountant, and a legal officer. The team will have real-time access to critical datasets, such as GSTIN information, e-way bill tracking, toll records, and RFID trail analytics, enabling swift and precise action against tax evasion.

Legal Framework and Impact

The SFDU will operate under robust legal provisions outlined in Sections 67, 70, 74, and 132 of the CGST/PGST Acts, as well as relevant sections of the Indian Penal Code (IPC). This will empower the unit to function as a technically advanced, intelligence-driven enforcement agency. Cheema highlighted that the initiative will be a decisive step toward dismantling extensive tax fraud networks, protecting the state’s revenue, and ensuring economic integrity.

Emphasizing that the SFDU’s establishment reflects the Aam Aadmi Party (AAP)-led Punjab Government’s commitment to creating a tax environment that is accountable, transparent, and effective against fraudulent activities, Cheema stated that the unit will play a pivotal role in safeguarding state revenue and promoting a culture of tax compliance.
